MP’s case referred to high court

GULF Governor, Havila Kavo, has been referred to the National Court on an ex-officio indictment by the public prosecutor, to answer charges on misappropriation.
This follows his acquittal by the Committal court last year, after that court found that “The evidence that was collected and obtained in the court file were not connecting” the charge of to the accused. Police then referred the matter to the Public Prosecutor’s office for its view, analysis and opinion on evidence collected and contained in the court file.
The Office of the Public Prosecutor used its inherent powers under Section 526 of the Criminal Code Act, to have the matter for trial through an ex-officio indictment. Governor Kavo was alleged to have misappropriated a sum of K133,338. It was alleged that between January 24 and February 5 2010, the accused was paid his outstanding entitlement of K133, 338 through the main Gulf Province operating account, by way of cheque printed from the provincial treasury office. The accused had claimed that that was his outstanding entitlement for August 2008–August 2009, as per SRC determination. The allowances included: official vehicle allowance-K83,760; support allowance-K25,788; domestic help-K3850; entertainment-K5200; utilities-K3000; telephone-K3750; and security-K6000. The total claimed was K133,338. His matter was listed last Monday and it has been adjourned to next week, Monday.
